Privacy Notice
Entorno A Ti, AC (hereinafter "EAT"), with address at Paseo de la Reforma 509, Floor 16, Suite 16000, Cuauhtémoc, CDMX CP 06500, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties, in order to guarantee the privacy and the right to information of people who share their personal data with us, we inform the following:
EAT will be responsible for the processing of your personal data, including financial, property, sensitive or any other type of personal data relating to you or the natural person you represent, which has been disclosed to this date or may be disclosed to EAT, whether derived from or as a consequence of your relationship as a donor with EAT (hereinafter referred to simply as "Personal Data").
Should you require any information regarding this Privacy Notice or in relation to the exercise of any of your rights derived from your Personal Data, including without limitation your rights of access, rectification, cancellation and opposition, as well as to limit its processing or revoke the consent that has been granted to us, please contact our Personal Data Department at the email address: privacidad@entornoati.org
Data we obtain from you.
Specifically, the Personal Data that we may request from you is the following: (i) full name; (ii) address; (iii) landline and/or mobile phone number; (iv) email; (v) date of birth; (vi) occupation; (vii) place of work; (viii) academic level and area of expertise; (ix) information regarding your participation in EAT actions or in instances of the organization; (x) information regarding your studies and professional or volunteer experience that may be relevant; (xi) Federal Taxpayer Registry (RFC); (xii) copy of your official identification, (xiii) thematic or campaign interests, and (xiv) data of legal representatives or persons mentioned as references, if applicable, such as: full name, CURP, RFC, address, occupation or position.
You acknowledge and agree that you have the consent of those individuals whose personal data you provide as references, on the understanding that such data will be governed by this Privacy Notice. We also collect contact information for the references you provide to us on the understanding that by providing such information to us you agree that we may contact your references.
Additionally, we will request Personal Data considered financial or patrimonial for the purpose of collecting donations or for obtaining and/or renewing your membership, such as your bank account or card details.
Finally, we may request Personal Data from you that is considered sensitive due to your association with a group of activists or with various campaigns or interests related to peace and human rights activities carried out through our organization, such as your membership in one of our groups of activists or supporters.
We inform you that your Personal Data will be treated confidentially and under the technical, administrative and physical security measures that ensure this and that EAT has implemented. By signing this privacy notice, you give your express written consent for us to process the aforementioned financial or patrimonial and sensitive Personal Data.
How to obtain your personal data.
EAT may collect your Personal Data either directly when you provide it to us and/or through other means such as email, our website, by telephone, or by any other remote means.
Purpose of obtaining and using personal data.
The Personal Data that EAT may request from you are those necessary to facilitate your access to our facilities and the execution and/or fulfillment of your relationship with EAT and that are reflected in the documents provided by you to EAT (including Personal Data of any of your representatives). Likewise, your Personal Data may be used to carry out tasks focused on contributing to the construction of a Mexico without corruption, provide information, services and products that you have requested, inform you about changes in them, include you in our requests, projects, activities and opportunities for action, evaluate the quality of the service we provide you and invite you to participate in the actions of the organization or in those in which it collaborates.
EAT will only collect the Personal Data necessary to carry out the purposes that give rise to and are considered necessary for the existence, maintenance and fulfillment of our relationship and the main purpose of EAT. In accordance with the above, your Personal Data (including financial or patrimonial and sensitive data) may be used by EAT or provided by it to its employees, officials, advisors, to: (i) carry out the purposes, fulfillment and development of the obligations that you have entered into or may enter into with EAT; (ii) comply with audits or inspections carried out on EAT, whether by external auditors or government entities; (iii) the creation of databases for administrative purposes; (iv) provide information, as well as documentation that is required by government entities or authorities in compliance with laws or regulations applicable to EAT; (v) address your complaints, questions, comments or project proposals or carry out action, education, promotion and research work, and (vi) send you notifications of changes to this privacy notice.
Protection of your personal data.
We undertake that your Personal Data will be treated under the administrative, physical and technical security measures established by the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, in order to prevent damage, loss, destruction, theft, misplacement, alteration and/or unauthorized processing.
In the event that EAT stores and processes your Personal Data through computer systems or via the Internet, we inform you that since electronic communications are not completely secure and any computer system is exposed to possible vulnerabilities that may affect its operation or security, EAT cannot guarantee that there will be no damage, loss, destruction, misplacement, alteration or unauthorized processing. EAT will comply with the administrative, physical and technical security measures in accordance with data protection regulations and any other regulations that, based on the data collected, are applicable.
Your rights to access, rectify, cancel or oppose the processing of your personal data.
As the owner of the Personal Data that you provide us, you will have the right to access the Personal Data that we hold and the details of the processing thereof; to rectify them if they are incomplete or inaccurate; to cancel them if you consider that they are not required for any of the purposes indicated in this Privacy Notice, they are being used for purposes for which you have not consented, or to oppose the processing of the Personal Data that you have provided us for specific purposes.
If you wish to exercise your rights of access, rectification, cancellation and/or opposition to the processing of your Personal Data, or have any questions or comments regarding the same, you may contact our Personal Data Department at the address and/or email address that appear in our contact details.
In terms of applicable law, any request to exercise the aforementioned rights must necessarily provide and indicate: (i) your name and address; (ii) a copy of your official identification (passport or voter registration card), (iii) a clear and precise description of the Personal Data to which you wish to access or to rectify, cancel or oppose and any other element that facilitates the location of your data, as well as (iv) any other requirement established by the Federal Law on the Protection of Personal Data Held by Private Parties and/or other applicable provisions. EAT will respond to any complete request within a maximum period of 20 business days or the maximum permitted by law. EAT's response will indicate whether the request for access, rectification, cancellation or opposition is admissible and, if applicable, EAT will make the determination effective within 15 business days following the date on which it communicates the response to the owner of the Personal Data or to his/her representative, as the case may be. The deadlines may be extended under the terms indicated by applicable law. EAT will provide electronic copies of your personal information if you exercise your right of access.
Ways you can limit the use or disclosure of your personal data.
You have the right, at any time, to totally or partially limit the use or disclosure of your Personal Data for those purposes that you consider are not necessary for the existence, maintenance and fulfillment of it, for this purpose, please send us an email or post addressed to our Personal Data Department, indicating either one or all of the purposes for which you wish to limit the use or disclosure of your Personal Data, in order to be registered on an exclusion list of which you will be provided with an electronic or physical certificate, as requested by us.
Ways to revoke your consent to the processing of your personal data.
You may revoke at any time the consent you have given us for the processing of your Personal Data by contacting our Personal Data Department, by email or in person at our offices, letting us know of such situation. We inform you that if you revoke your consent for the processing of your Personal Data (including financial and sensitive data), we will be unable to continue our legal relationship.
Transfer of your Personal Data.
EAT reserves the right to share your Personal Data with administrative, judicial or governmental authorities of any kind in Mexico or abroad, provided that this is established by judicial or administrative order or that a law so determines. EAT will share your information when it subcontracts third parties, suppliers, distributors, service providers, authorities of any nature that require to know said data so that EAT is able to establish a legal relationship with you, as well as lawyers, auditors, accountants or system managers that need to process your information on behalf of EAT and under EAT's instructions. EAT does not require your consent for these referrals.
Storage of Your Personal Data.
EAT may store your Personal Data in databases located in the United Mexican States, for the duration of the legal relationship with you and for an additional period of 5 years, except for the periods indicated by the applicable legislation, as well as to comply with the purposes indicated in this Privacy Notice, as stipulated in the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations and other applicable regulations.
Modifications to the Privacy Notice, Legislation and Jurisdiction.
We reserve the right to make changes or updates to this Privacy Notice at any time, in response to legislative developments, internal policies or new requirements for the development of our activity. In the event of changes to this Privacy Notice, we will notify you through the email address you have provided us, our offices or website. In any case, you will have the right to cancel and/or rectify your Personal Data, as well as to limit its use and disclosure or revoke your consent, in the event of changes to the terms of this Privacy Notice.
This Privacy Notice, the processing of your Personal Data and/or all related documents are governed by the Federal Law on the Protection of Personal Data Held by Private Parties and other regulations of the United Mexican States. Acceptance of this Privacy Notice or the execution of a contract of any nature with EAT, once the Privacy Notice is made available, implies express acceptance, in writing, of the terms thereof.
If you consider that your right to protection of Personal Data has been violated by any conduct of our employees or our actions or responses, or you suspect that in the processing of your Personal Data there is a violation of the provisions set forth in the Federal Law on Protection of Personal Data Held by Private Parties, you may file the corresponding complaint or claim with the National Institute for Transparency, Access to Information and Protection of Personal Data. The undersigned, in my own right and, where applicable, on behalf of the individuals I represent, declare that I understand and accept the terms of this Privacy Notice, I consent to my financial Personal Data being processed in accordance with the terms and conditions of this privacy notice and I consent to my Personal Data being transferred under the terms set forth therein.
